1. What's in these Terms?

These terms of use (“Terms”) tell you the rules for using www.cardanofoundation.org and www.cardano.org (our “Websites”).

2. Who we are and how you can contact us

Cardano Foundation (Cardano Stiftung) is a not-for-profit organisation based in Zug, Switzerland, tasked with advancing the Cardano blockchain as a public infrastructure across a wide range of industries. Our registered address is: Cardano Stiftung, Dammstrasse 16, 6300 Zug, Switzerland.

Reference to the Cardano Foundation in this Terms include reference to Cardano Foundation’s affiliates.

3. Acceptance of these Terms

By using our Websites , you confirm that you accept these Terms and that you agree to comply with them as well as with all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing this site.

Certain parts of our Websites or whole Websites in general may be subject to additional terms.

4. Our intellectual property – how you may use material on our Websites

We are the owner or licensee of all intellectual property rights in our Websites and in the materials published on it (“Materials”). Those works are protected by copyright and trademark laws and treaties around the world. All such rights are reserved.

The Materials are provided on an ‘as is’ basis for general information purposes only.

The Materials could include technical, typographical, or photographic errors. Cardano Foundation does not warrant that any of the Materials are accurate, complete or current. Cardano Foundation may make changes to the Materials at any time without notice. However, Cardano Foundation does not make any commitment to update the Materials.

Cardano Foundation makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Cardano Foundation does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Materials or otherwise relating to such Materials or on any websites linked to from these Websites.

6. Limitations of our liability for losses or damages suffered by you

In no event shall Cardano Foundation or its subcontractors be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Materials, even if Cardano Foundation or a Cardano Foundation authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

7. Use of forums

Your access to and use of any forum features provided on our Websites are subject to these Terms, alongside the Privacy Policy and any accompanying codes of conduct or guidelines. These documents collectively govern your interactions and conduct within the forum. We have the discretion to block users who violate these Terms or the Community Forum guidelines from posting and/or to terminate the user’s forum access.

You agree to defend, indemnify, and hold harmless the Cardano Foundation and its affiliates, officers, directors, employees, and contractors from any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising from or in any way connected with: (a) your use or attempted use of the forum features in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) any content or submissions you provide within the forum, including any claims of infringement, misappropriation, or other violations of intellectual property or other rights.

8. User account responsibilities

In case of registrations, you are responsible for protecting against unauthorized access. Keep your access data secret and do not disclose it to anyone. We are not responsible for lost, stolen or compromised access credentials or for access to your account by an unauthorized user if this was caused by you.

9. We are not responsible for websites we link to

Cardano Foundation has not reviewed all of the websites linked to its Websites and is not responsible for the contents of any such linked websites . The inclusion of any link does not imply endorsement by Cardano Foundation of the website. Use of any such linked website is at the user’s own risk.

10. No text or data mining or web scraping

You must not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our Websites or any services provided via, or in relation to, our Websites. This includes using (or permitting, authorising or attempting the use of):

  • Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of our Websites or any data, content, information or services accessed via the same.
  • Any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations.

The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of applicable copyright law.

To the extent such exclusion or limitation of text or data mining or web scraping activity is not allowed in your jurisdiction, this clause does not apply to you.

12. Rules about linking to our Websites

  • You may link to our Websites, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

We may update and change our Websites from time to time to reflect changes to our products, our users' needs, and our business priorities. We will try to give you reasonable notice of any major changes if we deem this necessary or useful.

Our Websites are made available free of charge, except where explicitly stated otherwise.

We do not guarantee that our Websites, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Websites for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal if we deem this necessary or useful.

15. Assignment

We may transfer our rights and obligations under these Terms to another organisation. We will always inform you in writing or other suitable form if this happens.

16. Governing Law and jurisdiction

These Terms are governed by and construed in accordance with the material laws of Switzerland under exclusion of its conflicts of laws provisions and you irrevocably submit to the exclusive jurisdiction of the courts of Zug, Switzerland. In case of imminent or actual infringement of its rights, Cardano Foundation reserves the right to call upon any other competent court for injunctive relief.
